Prohibited Items & Seller Conduct
What can't be listed on VirtuFlea Market, and the conduct we require from every buyer and seller.
Last updated August 31, 2026
This Policy keeps the Marketplace safe and lawful for everyone. It applies to every listing and every account.
1. Purpose
This Policy sets out what may not be listed or sold on VirtuFlea Market, and how we expect Buyers and Sellers to behave. It is part of our Terms of Service and applies in addition to Whop's Prohibited Products & Services Policy and Community Guidelines, both of which also govern this site because it runs on Whop's platform. Where our Policy and Whop's are both stricter than the other on a given point, the stricter rule applies here.
2. Prohibited items
You may not list, offer, or sell any of the following:
- Illegal goods. Anything illegal to own, sell, or ship where you or the buyer are located, including illegal drugs and drug paraphernalia.
- Weapons. Firearms, firearm parts, ammunition, explosives, and weapons that are illegal to sell or ship without a license.
- Counterfeit or replica goods. Items that use a brand's name, logo, or design without authorization, or that are marketed as "replica," "inspired by," or "first copy" of a branded product.
- Stolen property or items you do not have clear legal right to sell.
- Recalled or unsafe products, including items subject to an active government or manufacturer safety recall.
- Hazardous materials, including flammable, corrosive, radioactive, or toxic substances not safe for standard shipping or handling.
- Living animals and human remains or body parts.
- Alcohol, tobacco, vaping, and nicotine products.
- Prescription drugs, medical devices, and controlled substances, and health products marketed with unsubstantiated medical claims.
- Adult content or sexual services.
- Hateful or violent material, including items that promote discrimination, violence, or hatred against people based on a protected characteristic.
- Personal or financial data, gift cards, or currency obtained fraudulently, and services designed to manipulate reviews, engagement, or account metrics.
- Items infringing intellectual property rights of any third party.
- Regulated categories that require a license or title transfer we cannot support, such as motor vehicles, firearms requiring dealer transfer, and real estate.
- Event tickets resold in violation of applicable resale law or the ticket issuer's terms.
This list is illustrative, not exhaustive. We may remove any listing that we believe is unsafe, unlawful, or otherwise inappropriate for the Marketplace, even if not explicitly listed above.
3. Required seller conduct
As a Seller, you must:
- Use real photos of the actual item you are selling โ not stock images, manufacturer photos, or images of a different unit.
- Describe condition, flaws, and authenticity honestly and completely.
- Respond to buyer questions and order-related messages within a reasonable time.
- Complete every sale โ payment and delivery โ entirely through this site's checkout. You may not direct a Buyer to pay you off-platform (for example by cash app, wire, or a link outside the Marketplace) to avoid fees or buyer protection; doing so is a violation of these Terms regardless of who proposes it.
- Refrain from creating multiple accounts, fake reviews, or fake engagement to inflate your listings' visibility or reputation.
- Treat buyers and other sellers with respect โ harassment, threats, or abusive messages are not allowed.
- Comply with all applicable laws, including consumer protection, product safety, export/import restrictions, and any taxes owed on your sales.
4. Required buyer conduct
As a Buyer, you must:
- Pay only through this site's checkout โ never send a Seller money outside the Marketplace.
- Use our refund process in good faith, as described in our Returns & Buyer Protection Policy, rather than filing false or exaggerated claims.
- Treat sellers with respect โ harassment, threats, or abusive messages are not allowed.
5. Enforcement
If we believe a listing or account violates this Policy, we may, at our discretion and without prior notice:
- Remove or edit the listing.
- Issue a warning to the account.
- Cancel or refund an affected order.
- Suspend or permanently terminate the account.
- Withhold or reverse a payout pending investigation of a suspected violation.
- Report the activity to Whop, law enforcement, or another relevant authority where required or appropriate.
We may take these actions even if the listing has already sold, and a Seller is not entitled to payment for a transaction found to violate this Policy.
6. Reporting a listing or user
If you see a listing or user that you believe violates this Policy, report it through the support option in your Whop account for this Marketplace, or by messaging the operator's Whop profile directly, including the listing link or seller's page and a description of the issue.
